This is the small print of the contract that you enter into with Mimoods Design when you buy through our website. (Nothing stated or implied in these details will affect your statutory rights.)

An order for goods placed by you the buyer, through our website shall be subject to these terms and conditions. Nothing stated or implied in these terms and conditions shall affect the statutory rights of any customer.

All measurements are approximate.
The reproduction of colors is as accurate as the photographs and production process will allow.

Our website

We will attempt to ensure that the information available on the website at any time is accurate. However, we wil not be held liable for any errors or omissions. We will use all reasonable endeavours to correct errors and omissions as quickly as practicable after becoming aware or being notified of these. Whilst we attempt to be as accurate as possible with the specification and descriptions of the product offered for sale - we cannot be held responsible for any inaccuracies.

Using this website is in agreement to the Terms & Conditions set out below. By using this site you have accepted these terms. This site may include errors or inaccuracies which Mimoods Design reserves the right to alter. Any other information held within this site may also be altered by Mimoods Design at its own discretion and without notice. Mimoods Design provides no warranties of any kind for any information contained within this website and links to further material directly or indirectly accessed which may lead to errors, viruses or other offensive material. All products displayed within this site are subject to availability and the site owners’ final acceptance.

Copyright for the images shown on our website remains with the artist, publisher or owner of the original picture and further distribution of the images in whatever format may be the subject of legal proceedings.

Your warranty to us

You, the buyer warrant that all details provided by telephone or e-mail for the purpose of purchasing the goods are correct, that the credit card you are using is your own and that there are sufficient funds and/or sufficient unused limit available to cover the cost of the goods.

Queries and complaints

Mimoods Design endeavour to handle all enquries and fulfil all orders speedily, effectively and without incident, however, it is not possible to guarantee there will never be a problem. Should you have any complaints about our products or services, we request that these are put in writing and sent either by email or to Mimoods at Oude Loosdrechtseweg 167, 1215HE Hilversum, The Netherlands. Any complaint received will be acknowledge withint 10 working days and you will be informed of a projected time scale for dealing with that complaint, together with the steps we intend to take in dealing with it.

Privacy Policy (Data Protection)

Mimoods Design does not disclose buyers' information to third parties. Data collected by this site is used to: a. Take and fulfill customer orders b. Administer and enhance the site and service. Information is only disclosed to third-parties for goods delivery purposes.

Placing an order to purchase

All orders for goods shall be deemed to be an offer by you to purchase goods in accordance with these terms and conditions. You the buyer, are responsible for ensuring the accuracy of the details provided and this also applies to any bespoke orders at the time of placing an order. Upon receipt of an order, we will advise you by e-mail of the availability of the item(s) ordered. You may cancel your order prior to despatch without any penalty should these costs be unacceptable or for any other reason. No order submitted by you shall be deemed to be accepted by us unless and until we confirm acceptance of your order by e-mail. We are entitled to refuse any order placed by you and will not be required to provide an explanation. All orders placed via the internet will automatically receive a confirmation e-mail of the transaction, however, if we are unable to fulfil the order due to items being out of stock we will notify you by e-mail or telephone within 48 hours and the transation may be cancelled or we will agree alternative arrangements with you.

Pricing payment

All goods offered for sale through our website are priced in Euros (€). All prices quoted are inclusive of VAT. Mimoods is registered for NL VAT - VAT Registration Number: 8199.52.060.B01 Customs and import duties are not included. The customer is responsible for payment of any surcharges. We accept payments using Ideal or the options provided by PayPal (these include credit/debit cards Mastercard/Visa/American Express). Prices include postage and packaging. We will take all reasonable care, in so far as it is in our power to do so, to keep the details of your order and payment secure, but in the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party procures unauthorised access to any data you provide when accessing or ordering from the Site.

Dispatch

Please note that Mimoods aims to dispatch all orders within 48 hours. We operate Monday to Friday and not on public holidays. Estimated delivery times are to be used as a guide only and commence from the date of dispatch, Mimoods is not responsible for any delays caused by destination customs clearance processes.

Insurance

Mimoods insures each purchase during the time it is in transit until it is delivered to your specified delivery address. We require a signature for any goods delivered, at which point responsibility for your purchased goods passes to you. If you have specified a recipient who is not you for delivery purposes (for example as a gift) then you accept that evidence of a signature by them (or at that delivery address) is evidence of delivery and fulfilment by Mimoods and transfer of responsibility in the same way.

Overseas delivery

All orders are processed in Euros (€). Overseas deliveries are subject to local import duties and taxes which are payable by the customer upon receipt, and maybe affected by Customs and Excise delays.

Returns policy

At Mimoods we pride ourselves upon your satisfaction. We want you to be happy with your purchase. While we hope that you are delighted with your order, if you are not perfectly satisfied with your goods we will happily offer you a full refund or exchange. Please notifiy us of your intentions to return the Item within 48 hours of delivery. You can return the item (s) within 14 days for a full refund (does not incude your postage). This item(s) must not be worn and must have all the tags and pricing info attached. Except where goods you return are faulty or damaged, you are responsible for the cost of returning the goods to us. As we have a stringent quality process before the goods leave us, Mimoods reserves the right to refuse any refund if we suspect the goods have been worn or damaged. We strongly reccomend that you send returns by recorded delivery and obtain proof of postage as we cannot be held responsible for goods lost or damaged in transit. Goods are returned to Mimoods Design at your own cost. Postage costs will only be refunded if goods are faulty (your statutory rights will not be affected).

Please note:
New and unused means that there are no marks on the item or any wear on the tags. We do not sell used items and will not accept any item with any indication that it was used. In such cases, the item will be returned to the purchaser. Mimoods is not responsible for any item that is not returned in the manner set forth above. Please be aware that international customs duties and sales taxes are not refunded for any shipments.

Law and Jurisdiction

All matters concerning and incidental to any offer or agreement for the purchase and sale of good act from our website shall be in English or Dutch. The contract shall be deemed to made in The Netherlands. All contracts made between Mimoods Design and the customer shall be governed by the Dutch laws and any dispute arising therein shall be subject to the sole jurisdiction of the Dutch courts.

Alterations to the terms and conditions, waiver & governing law

Mimoods Design reserves the right to amend these Terms & Conditions if necessary. No delay or failure to take action under these Terms & Conditions shall constitute any waiver by Mimoods Design of any provision of these Terms & Conditions. If any provision of these Terms & Conditions is invalid or unenforceable under applicable law, it is, to that extent, deemed enforceable to the fullest extent possible (and severable in the event such provision is completely unenforceable) and the remaining provisions of these Terms & Conditions will continue in full force and effect. Any claim under these Terms & Conditions must be brought within one (1) year after the cause of action arises. These Terms & Conditions are personal to you and may not be transferred, assigned or delegated to anyone. Any attempt by you to assign, transfer or delegate these Terms & Conditions shall be null and void. Mimoods Design may freely assign these Terms & Conditions without consent or notice.
